Zarzuela was arrested on April 4 and charged with assault, reckless endangerment and harassment for allegedly punching another victim at Grand Central Terminal. He was released without bail

Sad they let him out a few days earlier so he could sucker punch a child.

I know our justice system is garbage but no need to make it worse by instituting some sort of pre-crime judgement. You can't keep people in jail who have not been found guilty and you can't keep people in jail because they might do something. Bail is meant to ensure that people show up to court, it is not meant to be a punishment. If there was no reason to assume he would skip town then there really was no reason to impose bail. Yes, you run the risk that they might commit additional crimes, but most don't.

Per this article, in this case it looks like after the initial attack bail actually was set ($2,500 cash bail or $10,000 bond), but he had to be released after the police and prosecutors didn’t get depositions from either the MTA detective or the victim within the mandatory 5 days. It doesn’t explain what caused the delay, but bail was initially set.

If the person has a higher chance of being a danger to the public, the bail amount is set much higher…

If they don’t get a deposition, they can’t hold or charge them and have to release them. The victim might have chosen not to pursue charges. One of my sons was punched by a stranger when he was four. The person had significant disabilities and did not understand what they were doing, they had gotten away from their caretaker who was extremely apologetic. Yes it was extremely upsetting but given the persons diminished capacity, we didn’t press any charges. I don’t know this persons situation but the lack of mental health and disability care given to the uninsured causes incidents like this.

I’m not gonna lie my friend, mental illness would not stop me from defending myself if some strange man punched me in the face, much less a child.

Somebody better get him some help before he hits the wrong person.
